South Australian Consolidated Acts25—Grounds for, and manner of, appeal
(1) A person may
appeal against a requirement imposed under this Part.
(2) An appeal under
this section lies to the Council and must be instituted by a written notice of
appeal setting out, in detail, the grounds of appeal.
(3) An appeal must be
instituted within 14 days of the requirement being imposed under this Part
unless the Council, in its discretion, allows an extension of time for
instituting the appeal.
(4) Subject to a
determination by the Council to the contrary in relation to a particular
appeal, where an appeal has been instituted, the requirement appealed against
is suspended until the appeal has been determined or withdrawn.
(5) An appeal under
this section is to be conducted as a full review of the matter to which the
appeal relates.
(6) An appeal under
this section must be dealt with as expeditiously as possible.
