Where—
(a) a
person is required by a notice under this Part to take any action; and
(b) the
circumstances out of which the requirement arose are attributable to the act
or default of another,
the person may recover the amount of the costs and expenses reasonably
incurred in complying with the notice from that other person as a debt.
