Where the Authority has made—
(a) a
determination under section 21 or 22 that a complaint should not be
investigated or further investigated under this Act; or
(b) a
determination under section 23 that a matter should be investigated by
him or her,
the Commissioner may nevertheless, in his or her discretion, but subject to
any determination under section 23(3)(b), direct that the matter or part
of the matter concerned be investigated or further investigated, but, in that
event, the provisions of this Act will not apply to or in relation to that
investigation or further investigation.
