(1) Subject to
subsection (2), the Commissioner may, at the Commissioner's discretion,
suspend or terminate the appointment of a community constable.
(2) The Commissioner
must not take action against a community constable under this section because
of any incapacity of the community constable to perform duties that results
from physical or mental disability or illness of the community constable
without first complying with the requirements of the
Police Superannuation Act 1990 .
