South Australian Consolidated Acts54—Power to require information
(1) The Minister or a
person authorised by the Minister may, by notice in writing, require a person
to furnish information relating to occupational health, safety or welfare that
is reasonably required for the administration, operation or enforcement of
this Act.
(1a) The
Advisory Committee may, by notice in writing, require the Department to
furnish information necessary for the performance of the Advisory Committee's
functions.
(2) A person is not
required to provide under subsection (1)—
(a)
information that is privileged on the ground of legal professional privilege;
or
(b)
information that is relevant to proceedings that have been commenced under
this Act; or
(c)
information that would tend to incriminate the person who has the information
of an offence; or
(d)
personal information regarding the health of a person who does not consent to
the disclosure of the information.
