South Australian Consolidated Acts23A—Duties of designers and owners of buildings
(1) A person who
designs a building that is reasonably expected to comprise or include a
workplace must—
(a)
ensure so far as is reasonably practicable that the building is designed so
that people who might work in, on or about the workplace are, in doing so,
safe from injury and risks to health; and
(b)
ensure that the building complies in all respects with prescribed requirements
(if any) applicable to it.
Maximum penalty:
(a) for
a first offence—Division 2 fine;
(b) for
a subsequent offence—Division 1 fine.
(2) The owner of a
building that comprises or includes a workplace must—
(a)
ensure so far as is reasonably practicable that the building, and any fixtures
or fittings within the building that are under the control of the owner, are
in a condition that allows people who might work in, on or about the workplace
to be safe from injury and risks to health; and
(b)
ensure that the building complies in all respects with prescribed requirements
(if any) applicable to it.
Maximum penalty:
(a) for
a first offence—Division 2 fine;
(b) for
a subsequent offence—Division 1 fine.
(3) In this
section—
"building" includes a part of a building.
