South Australian Consolidated Acts12—Validity of acts of the Council and immunity of members
(1) No act or
proceeding of the Council is invalid by reason only of a vacancy in the office
of a member, or a defect in the appointment of a member.
(2) No liability
attaches to a member for any act or omission by the member, or by the Council,
in good faith and in the exercise, or purported exercise, of powers or
functions or in the discharge, or purported discharge, of duties under this
Act.
(3) A liability that
would, but for subsection (2), attach to a member of the Council attaches
instead to the Crown.
