MOTOR VEHICLES ACT 1959 - SECT 98AAG
98AAG—Exemptions for Aboriginal persons in remote areas
(1) Subject to this
section, the Minister may, by instrument in writing or by notice in the
Gazette—
(a)
exempt a specified person, or a person of a specified class, from specified
provisions of this Part subject to such conditions as the Minister thinks fit
and specifies in the instrument or notice of exemption; or
(b) vary
or revoke an exemption, or a condition of an exemption, under this section or
impose a further condition.
(2) An exemption under
this section may only be granted for the purpose of enabling an
Aboriginal person who ordinarily resides in a remote area to obtain a licence
under this Act.
(3) An exemption under
this section expires when the person to whom the exemption applies is issued
with an unconditional licence under this Act.
(4) In this
section—
"Aboriginal person" means a person of Aboriginal descent who is accepted as a
member by a group in the community who claim Aboriginal descent;
"remote area" means—
(a) the
lands as defined in the A n angu Pitjantjatjara Yankunytjatjara
Land Rights Act 1981 ; or
(b) the
lands as defined in the Maralinga Tjarutja Land Rights Act 1984 ; or
(c)
lands prescribed by regulation.
