MOTOR VEHICLES ACT 1959 - SECT 114
114—Certain defences ineffective in actions against insurers
It is not a defence to an action under section 112 or 113 that the
insurer is not liable under a policy of insurance by reason of the fact
that—
(a) the
policy was obtained by mis-statement or non-disclosure; or
(b) the
insured person has committed a breach of or failed to comply with a term,
condition or warranty of the policy or a provision of this Part.
