South Australian Consolidated Acts25—Offence in relation to obtaining permission to carry out mining
operations
(1) A person who,
without the consent of the Minister of Mines and Energy, gives, offers, or
agrees to give, a payment or other consideration to another person (not being
a payment or consideration in discharge or partial discharge of a liability
arising under this Act) in connection with obtaining the permission of
Maralinga Tjarutja to carry out mining operations upon the lands shall be
guilty of an offence and liable to a penalty not exceeding two thousand
dollars.
(2) Where a body
corporate commits an offence against subsection (1), each director of the
body corporate shall be guilty of an offence and liable to a penalty not
exceeding two thousand dollars unless he proves that he could not, by the
exercise of reasonable diligence, have prevented the commission of the offence
by the body corporate.
