South Australian Consolidated Acts26—Terms and conditions of appointed members
(1) A member of the
Tribunal appointed by the Governor will be appointed on conditions determined
by the Governor and for a term, not exceeding 3 years, specified in the
instrument of appointment and, at the expiration of a term of appointment, is
eligible for reappointment.
(2) The Governor may
remove an appointed member of the Tribunal from office—
(a) for
breach of, or non-compliance with, a condition of appointment; or
(b) for
misconduct; or
(c) for
failure or incapacity to carry out official duties satisfactorily.
(3) The office of an
appointed member of the Tribunal becomes vacant if the member—
(a)
dies; or
(b)
completes a term of office and is not reappointed; or
(c)
resigns by written notice to the Minister; or
(d)
ceases to satisfy the qualification by virtue of which the member was eligible
for appointment to the Tribunal; or
(e) is
removed from office under subsection (2).
(4) If an appointed
member of the Tribunal is a member constituting the Tribunal for the purposes
of any proceedings under Part 5 and the member's term of office expires, or
the member resigns, before those proceedings are completed, the member may,
for the purpose of continuing and completing those proceedings, continue to
act as a member of the Tribunal.
