South Australian Consolidated Acts (2) For the purposes
of this Act the Minister shall be a body corporate, having perpetual
succession and a common seal, and in his corporate name may sue and be sued
and hold and dispose of land.
(3) The powers by this
Act granted to the Minister to make contracts may be exercised as follows:
(a) any
contract which, if made between private persons, would be by law required to
be in writing and under seal, the Minister may make in writing in his
corporate name under his common seal;
(b) any
contract which, if made between private persons, would be by law required to
be in writing and signed by the parties thereto, may be made by the Minister
or any person acting under his authority (express or implied), in writing
signed by the Minister or such person;
(c) any
contract which, if made between private persons, would be by law valid
although made by parol only and not reduced into writing, may be made by parol
by the Minister or by any person acting under his authority (express or
implied).
(4) A contract made
according to this section shall be effectual in law, and binding on the
Minister and his successors and all other parties thereto.
(5) A contract made by
or on behalf of the Minister may be varied or discharged in the same manner in
which it is authorised by this section to be made.
