South Australian Consolidated Acts45—Payment of rents to Minister
(1) All rents and
other payments payable to the Minister—
(a)
under all leases and licences of land within an irrigation area granted before
the commencement of this Act by the Minister or the Commission; and
(b)
under all leases, permits, and licences granted or made by the Minister under
or pursuant to this Act,
shall be payable to the Minister.
(2) Payment of rent or
any other payment made to the Minister or any person authorised in that behalf
by the Minister shall be a sufficient discharge of such rent or money paid.
(3) If any rent or
other payment payable to the Minister of Irrigation is in arrear, the
Minister, without prejudice to the right of the Minister to recover in any
other way, may sue for the same, together with interest at the rate of five
per centum per annum, and the costs attendant thereon, by action in his own
name in any court of competent jurisdiction as a debt due to him.
(4) The Minister may
extend the time for payment of any amount payable to the Minister under this
section: Provided that on all such extensions interest may, at the discretion
of the Minister, be charged on such amounts at the rate of five per centum per
annum.
(5) All such leases,
permits, and licences granted or made by the Commission or the Minister shall
be construed to give effect to this section.
