HARBORS AND NAVIGATION ACT 1993 - SECT 76
76—Duty to give assistance and provide particulars
(1) If an accident
involving a vessel occurs in the jurisdiction resulting in—
(a) loss
of life or personal injury or possible loss of life or personal injury; or
(b)
damage to a vessel or possible damage to a vessel,
a person who is in a position to do so must take any action that is reasonably
practicable in the circumstances to prevent or minimise the loss, injury or
damage.
Maximum penalty:
(a) in
the case of a person who was the operator of a vessel involved in the
accident—imprisonment for 5 years;
(b) in
any other case—$5 000.
(2) If an accident
occurs involving a vessel, the person who was in charge of the vessel at the
time of the accident must inform any person injured in the accident and the
owner of any property damaged in the accident of the person's name and address
and of the registration number of the vessel.
Maximum penalty: $1 250.
