South Australian Consolidated Acts38—Obligation to have adequate crew
(1) If a
fishing vessel to which this Part applies is operated in the jurisdiction and
the crew of the vessel does not conform to the requirements of the regulations
with regard to the minimum number and qualifications of the crew, the owner is
guilty of an offence.
Maximum penalty: $5 000.
(2) If a vessel (other
than a fishing vessel) to which this Part applies is operated in the
jurisdiction and—
(a)
there is no current determination of the State Crewing Committee fixing the
minimum number and qualifications of the crew required for the safe navigation
of the vessel; or
(b) the
crew of the vessel does not comply with the requirements of such a
determination,
the owner and the master of the vessel are each guilty of an offence.
Maximum penalty: $5 000.
