HEALTH AND COMMUNITY SERVICES COMPLAINTS ACT 2004 - SECT 85
85—Determining reasonableness of health or community service provider's
actions
(1) In determining
whether a health or community service provider has acted reasonably, the
Commissioner must have regard to—
(a) the
Charter; and
(b) the
principles specified in section 22; and
(c) the
generally accepted standard of health or community service delivery expected
of a provider of that kind,
and may have regard to any other matter or information the Commissioner
considers relevant.
(2) The Commissioner
must, in making a decision on a complaint under this Act, take into account
the level of resources reasonably available to the health or
community service provider.
