South Australian Consolidated Acts34—The Commissioners
(1) The Commissioners
are the persons appointed by the Governor as Commissioners.
(2) Before a person is
appointed (or reappointed) as a Commissioner, the Minister must consult
confidentially about the proposed appointment with a panel consisting
of—
(a) a
nominee of the United Trades and Labor Council; and
(b) a
nominee of the South Australian Employers' Chamber of Commerce and Industry;
and
(c) a
nominee of the House of Assembly appointed by resolution of that House; and
(d) a
nominee of the Legislative Council appointed by resolution of the Council; and
(e) the
Commissioner of Public Employment,
(and for the purposes of the consultation must inform the members of the panel
all persons short-listed for appointment).
(3) A Commissioner
must be a person of standing in the community with experience in industrial
affairs either through association with the interests of employees or through
association with the interests of employers and the number of Commissioners of
the former class must be equal to, or differ by no more than one from, the
number of Commissioners of the latter class (part-time Commissioners being
counted for the purposes of this subsection by reference to the proportion of
full-time work undertaken).
