FAIR TRADING ACT 1987 - SECT 42

42—Substantiation of claims

        (1)         The Commissioner may, by notice in writing, require a person, who publishes or causes to be published a statement promoting, or apparently intended to promote, the supply of goods or services or the sale or letting of premises by the person, to provide the Commissioner, within the period specified in the notice, with proof of any claim or representation made in the statement.

        (2)         A person, on whom a notice under this section is served, who—

            (a)         fails to provide proof sufficient to support the claim or representation; or

            (b)         fails to provide that proof by the time specified in the notice,

is guilty of an offence.

Maximum penalty: $10 000.
