South Australian Consolidated Acts (1) In this Part,
unless the contrary intention appears—
"file" means any repository or record in which information relating to any
person is recorded or retained, in any manner or form, by a reporting agency;
"prescribed benefit" means—
(a) a
benefit of a commercial nature; or
(b) a
benefit in or affecting employment; or
(c) a
lease of premises or a licence conferring a right to occupy premises;
"prescribed report" means a communication made to a trader by a
reporting agency or another trader of information relating to a person, not
being a communication made with the knowledge of, and of information known to,
that person;
"reporting agency" means a person who carries on the business of providing
prescribed reports.
(2) For the purposes
of this Part, where a prescribed report consists of a communication by
electronic or mechanical means (except by telephone or other means of voice
transmission) the report will be regarded as being written.
