FIRE AND EMERGENCY SERVICES ACT 2005 - SECT 105D
(1) A
fire prevention officer may delegate any of his or her functions or powers
under this or any other Act—
(c) with
the approval of the council—to any other person or body.
(2) A delegation under
this section—
(a) must
be by instrument in writing; and
(b) may
be absolute or conditional; and
(c) does
not derogate from the ability of the fire prevention officer to act in any
matter; and
(d) is
revocable at will.
(3) A function or
power delegated under this section may, if the instrument of delegation so
provides, be further delegated.
(4) If a
fire prevention officer delegates a function or power under this section, he
or she must report that fact to the council.
