FAMILY AND COMMUNITY SERVICES ACT 1972 - SECT 7

7—Incorporation of the Minister

        (1)         The Minister for Family and Community Services and his or her successors in office continue to be a corporation sole.

        (2)         The Minister is, as a corporation sole, capable of—

            (a)         suing and being sued; and

            (b)         acquiring, holding, dealing with and disposing of real and personal property of any kind; and

            (c)         acquiring or incurring any other rights or liabilities.

        (3)         In any legal proceedings, where a document purports to bear the signature or the common seal of the Minister, the document will, in the absence of evidence to the contrary, be taken to have been duly executed by the Minister.
