South Australian Consolidated ActsSchedule 2—Transitional provisions
(1) The Commission is
the same body corporate as the South Australian Independent Industry Regulator
established under the Independent Industry Regulator Act 1999 .
(2) A reference in an
Act or instrument to the South Australian Independent Industry Regulator is
(where the context permits) to be read as a reference to the Commission.
(3) A delegation,
appointment, determination, requirement, decision, order, code or rule made
under a provision of the Independent Industry Regulator Act 1999 and in
force under that Act immediately before the commencement of this clause
continues subject to this Act as if made under the corresponding provision of
this Act.
(4) Subject to this
Act, the person immediately before the commencement of this clause holding the
office of the South Australian Independent Industry Regulator is to be taken
to have been appointed as the Chairperson of the Commission until—
(a) the
end of the period when the person's term of appointment as the Independent
Industry Regulator would have expired; or
(b) if
the Governor extends the period under this clause, the end of the period as so
extended.
(5) The
Acts Interpretation Act 1915 applies, except to the extent of any
inconsistency with the provisions of this Schedule, to the repeal effected by
this Act.
