EQUAL OPPORTUNITY ACT 1984 - SECT 84
84—Exemption for unjustifiable hardship
(1) This Part does not
render unlawful discrimination by a person on the ground of disability in
relation to the provision of access to or use of a place or facilities if the
provision of access or use would impose unjustifiable hardship on the person.
(2) In determining
what constitutes unjustifiable hardship, all relevant circumstances of the
particular case are to be taken into account including—
(a) the
nature of the benefit or detriment likely to accrue or be suffered by the
persons concerned; and
(b) the
effect of the disability of the person concerned; and
(c) the
financial circumstances and the estimated amount of expenditure required to be
made by the person claiming unjustifiable hardship.
