South Australian Consolidated Acts13—Powers of Magistrates Court in the event of rescission
(1) In a dispute
arising out of the rescission of a consumer contract, the Magistrates Court
may, on the application of a consumer or supplier, make such orders as may be
necessary—
(a) to
give effect to, or to enforce, rights or liabilities consequent on the
rescission arising under this Act; or
(b)
subject to such rights or liabilities, to restore the parties as nearly as
practicable to their respective positions prior to the formation of the
consumer contract.
(2) The jurisdiction
conferred by this section is not exclusive of any other jurisdiction of a
court.
