CONTROLLED SUBSTANCES ACT 1984 - SECT 30ZZB
30ZZB—Employee must comply with terms and conditions of licence
(1) A licensed grower
must take reasonable steps to prevent an employee of the licensed grower
contravening the terms, conditions, limitations or restrictions of the poppy
cultivation licence and the applicable requirements of this Part in carrying
out an activity authorised by the licence.
Maximum penalty: $10 000.
(2) A licensed
processor must take reasonable steps to prevent an employee of the licensed
processor contravening the terms, conditions, limitations or restrictions of
the licence and the applicable requirements of this Part in carrying out an
activity authorised by the licence.
Maximum penalty: $10 000.
(3) A licensed grower
must take reasonable steps to provide each employee of the licensed grower
carrying out an activity authorised under the poppy cultivation licence with
sufficient and appropriate information, instruction, training and supervision
to be able to carry out that activity in accordance with the licence.
Maximum penalty: $10 000.
(4) A licensed
processor must take reasonable steps to provide each employee of the licensed
processor carrying out an activity authorised under the poppy processing
licence with sufficient and appropriate information, instruction, training and
supervision to be able to carry out that activity in accordance with the
licence.
Maximum penalty: $10 000.
(5) An employee must
cooperate with the licensed grower in relation to any direction given, or
action taken, by the licensed grower or by any person authorised by the
licensed grower, in order to comply with subsection (1) or (3).
Maximum penalty: $10 000.
(6) An employee must
cooperate with the licensed processor in relation to any direction given, or
action taken, by the licensed processor or by any person authorised by the
licensed processor, in order to comply with subsection (2) or (4).
Maximum penalty: $10 000.
