sell by wholesale or by retail or supply a poison, therapeutic substance or
therapeutic device that does not conform with the regulations.
Maximum penalty: $10 000.
(2) It is a defence
for a person charged with an offence against this section to prove that he or
she did not know and could not, by the exercise of reasonable diligence, have
known that the subject matter of the offence did not conform with the
regulations.
