South Australian Consolidated Acts17—Reduction of minimum penalty
Where a special Act fixes a minimum penalty in respect of an offence and the
court, having regard to—
(a) the
character, antecedents, age or physical or mental condition of the defendant;
or
(b) the
fact that the offence was trifling; or
(c) any
other extenuating circumstances,
is of the opinion that good reason exists for reducing the penalty below the
minimum, the court may so reduce the penalty.
