Subject to section 38(1), the Court may remit any matter referred to
arbitration by an arbitration agreement together with any directions it thinks
proper to the arbitrator or umpire for reconsideration or, where a new
arbitrator or umpire has been appointed, to that arbitrator or umpire for
consideration.
