South Australian Consolidated Acts (1) Unless otherwise
agreed in writing by the parties to the arbitration agreement, where an
arbitration agreement provides for the appointment of an even number of
arbitrators, the arbitrators may appoint an umpire at any time after they are
themselves appointed and shall do so forthwith if they fail to determine a
matter arising for determination.
(2) An umpire
appointed in relation to an arbitration is not required to sit with the
arbitrators while the arbitrators are conducting proceedings under the
arbitration agreement.
