South Australian Consolidated ActsIn this Division—
"affairs", in relation to a co-operative, includes—
(a) the
promotion, formation, membership, control, transactions, dealings, business
and property of the co-operative; and
(b)
loans made to the co-operative; and
(c)
matters that are concerned with identifying people who are, or have been,
financially interested in the success or failure, or apparent success or
failure, of the co-operative or who are, or have been, able to control or
influence materially the policies of the co-operative; and
(d) the
circumstances in which a person placed, withdrew or disposed of funds with, or
loans to, the co-operative;
"costs", in relation to an inquiry under this Division, includes—
(a) the
expenses of, and incidental to, the inquiry; and
(b) the
expenses payable by the Commission in any proceedings instituted by the
Commission under this Division in the name of the co-operative the subject of
the inquiry; and
(c) so
much of the remuneration of an officer or employee of the Crown as is
determined by the Commission to be attributable to matters connected with the
inquiry;
"investigator" means a person appointed under section 399;
"involved person", in relation to an inquiry into the affairs of a
co-operative, means—
(a) an
officer of the co-operative; or
(b) a
person who acts, or has at any time acted, as banker, solicitor, auditor or
actuary, or in any other capacity, for the co-operative; or
(c) a
person who has, or at any time had, in his or her possession any property of
the co-operative; or
(d) a
person who is indebted to the co-operative; or
(e) a
person who is capable of giving information relating to the affairs of the
co-operative; or
(f) a
person whom an investigator believes on reasonable grounds to be a person
referred to in paragraphs (a) to (e).
