South Australian Consolidated Acts23—Commencement of prosecutions
(1) A prosecution for
an offence against this Act cannot be commenced except by—
(a) the
Commission; or
(b) a
person authorised in writing by the Commission.
(2) In proceedings for
an offence against this Act, an allegation in the complaint that the
complainant is a person authorised in writing by the Commission to commence
the prosecution is to be accepted, in the absence of proof to the contrary, as
proved.
