ASSOCIATIONS INCORPORATION ACT 1985 - SECT 49A
49A—General power of exemption of the Commission
(1) The Commission
may, on the application of an incorporated association, an officer of an
incorporated association, or a person authorised by an
incorporated association to make an application under this section—
(a)
extend any limitation of time prescribed by or under this Act whether or not
the prescribed period has expired; or
(b)
exempt the association or any officer of the incorporated association from the
obligation to comply with any provision of this Act.
(2) An application
under subsection (1) may be granted by the Commission on such conditions
as it thinks fit.
(3) Where an
incorporated association or an officer of an incorporated association
contravenes or fails to comply with a condition imposed by the Commission
under subsection (2), the association or the officer (as the case may be)
is guilty of an offence.
Maximum penalty:
(a) if
the offence is committed in respect of a prescribed
association—$5 000; or
(b) in
any other case—$1 250.
(4) The Commission
may, at any time by instrument in writing, revoke or vary an extension or
exemption under subsection (1).
