(1) Every Act and
every provision of an Act will be construed so as not to exceed the
legislative power of the State.
(2) Any Act or
provision of an Act which, but for this section, would exceed the power of
the State, is nevertheless a valid enactment to the extent to which it does
not exceed that power.
