A statutory or other instrument made pursuant to a power conferred by or under
an Act will be read and construed so as not to exceed that power, so that,
where a provision of the instrument, or the application of a provision of the
instrument to any person or circumstances, is in excess of that power, the
remainder of the instrument, or the application of the provision to other
persons and circumstances, is not affected.
