HEALTH AND HOSPITALS NETWORK ACT 2011 No. 32 - SECT 44

44 Minister may give directions to network

(1) The Minister may give a network a written direction about a matter relevant to the performance of its functions under this Act, if the Minister is satisfied it is necessary to do so in the public interest.

(2) Without limiting subsection (1), the Minister may direct a network to give the Minister stated reports and information.

(3) However, the Minister may not give a direction about—

(a) the health services provided, or to be provided, to a particular person; or
(b) the employment of a particular person.

(4) A network must comply with a direction given by the Minister.

(5) A network's annual report under the Financial Accountability Act 2009 for a financial year must include a statement about the directions given by the Minister to the network during the financial year.
