Notice of intention to defend
85 Notice of intention to defend
(1) Despite an originating process being against a partnership, a notice of
intention to defend must not be filed in a partnership name.
(2) A partner
who is served with an originating process against a partnership may file a
notice of intention to defend only in the partner’s own name. Note— See
rule 114 (Service in relation to a partnership).
(3) However, the
proceeding continues in the name of the partnership.
