Preconditions to making of graffiti removal order
194A Preconditions to making of graffiti removal order
(1) A court must make a graffiti removal order against a child found guilty by
a court of a graffiti offence unless the court is satisfied that, because of
the child’s physical or mental capacity, the child is not capable of
complying with the order.
(2) A court must, when deciding the number of hours
of graffiti removal service to order under a graffiti removal order, take into
account the age, maturity and abilities of the child against whom the order
will be made.
