(1) This section applies if the chief executive, regulator or an authorised
officer reasonably believes—
(a) a person—
(i) is contravening a provision
of this Act; or
(ii) has contravened a provision of this Act in circumstances
that make it likely the contravention will continue or be repeated; and
(b) a
matter relating to the contravention is reasonably capable of being rectified;
and
(c) it is appropriate to give the person an opportunity to rectify the
matter.
(2) The chief executive, regulator or authorised officer may give the
person a notice (a
"compliance notice" ) requiring the person to remedy the contravention.
(3)
Subsection (4) applies if the giving of the compliance notice is for a matter
for which a show cause notice has been given by the regulator.
(4) The
compliance notice may be given only if, after considering any properly made
submission by the service provider about the show cause notice, the regulator
still believes it is appropriate to give the compliance notice.
