(d) decommissioned from use or removed
because of steps taken to prevent or minimise the impact of the failure of the
dam under section 359A.
(2) For this Act and the Planning Act, the
development permit for the dam is taken to be cancelled and of no effect on
and from the day the dam is decommissioned from use or removed.
(3) The chief
executive must, as soon as practicable after the dam is decommissioned from
use or removed, give the local government for the area in which the dam is
located notice of the decommissioning or removal.
