(1) This section applies to the owner of a referable dam if an emergency event
relating to the dam happens.
(1A) For subsection (1) , an emergency event
relating to the dam happens if—
(a) a person or property has been or may be
harmed because of the event; and
(b) any of the following applies—
(i) a
coordinated response involving 2 or more of the relevant entities mentioned in
paragraphs (b) to (d) of the definition "relevant entity" was required to respond to the event;
(ii) the event arose
because of a disaster situation declared under the Disaster Management Act;
(iii) an entity performing functions under the State disaster management plan
has, under that plan, required the owner of the dam to give the entity
information about the event.
(2) The owner of the dam must, unless the owner
has a reasonable excuse, prepare a report (an
"emergency event report" ) under this subdivision and give it to the chief
executive within—
(a) 30 business days after the end of the emergency event;
or
(b) if a further period is agreed in writing by the chief executive and
the owner of the dam—the further period.
