352Q Amending plan by agreement
(1) The owner of a referable dam may ask the chief executive to amend the
approved emergency action plan for the dam to—
(a) correct a minor error; or
(b) make another change that is not a change of substance.
(1A) Without
limiting subsection (1) (b) , the owner may, within 10 business days after a
change in ownership of the dam, ask the chief executive to amend the approved
emergency action plan to—
(a) record the change in ownership of the dam; and
(b) make other changes to the plan required because of the change in
ownership.
(2) The request must be in writing and accompanied by a copy of
the plan showing the proposed amendment.
(3) The chief executive may—
(a)
decide to approve or refuse the amendment; and
(b) give the owner notice of
the decision.
(4) If, within 10 business days after the request is made, the
chief executive has not decided to approve or refuse to approve the amendment,
the chief executive is taken to have approved the amendment.
(5) If the
amendment is approved under this section, the plan as amended is taken to be
the approved emergency action plan.
