WATER SUPPLY (SAFETY AND RELIABILITY) ACT 2008 - SECT 352P

352P Review by dam owner

(1) The owner of a referable dam must, before the review day each year—

(a) review the approved emergency action plan for the dam; and

(b) give the chief executive—

(i) a notice stating whether or not the owner proposes an amendment of the plan because of the review; and

(ii) if the owner proposes an amendment—a copy of the plan including the proposed amendment.

Penalty—

Maximum penalty—500 penalty units.

(2) For subsection (1) , the review day is—

(a) if, before 1 October in a year, the chief executive gives the owner written notice stating a day, not earlier than 30 business days after the notice is given, for compliance with subsection (1) in the year—the day stated in the notice; or

(b) otherwise—1 October.

(3) However, a notice may not be given under subsection (2) (a) later than 30 business days before 1 October in the year.
