WASTE REDUCTION AND RECYCLING ACT 2011 - SECT 266

266 Protection of officials from liability

(1) An official does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.

(2) If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the State.

(3) This section does not apply to an official if the official is a prescribed person under the Public Sector Act 2022 , section 267 .

(4) In this section—


"official" means any of the following persons—

(a) the Minister;

(b) an authorised person;

(c) a person acting under the direction of—

(i) a person mentioned in paragraph (a) or (b) ; or

(ii) the chief executive.
