Adoption of plan following consultation
125 Adoption of plan following consultation
(1) A local government must by resolution adopt a waste reduction and
recycling plan, or an amendment of a waste reduction and recycling plan,
before the plan or amendment is implemented in its local government area.
(2)
Before adopting the plan or amendment, the local government must consult with
the public about the proposed plan or amendment.
(3) The level of
consultation must be appropriate in the circumstances, having regard to the
level of significance of the plan or amendment.
(4) However, if a new waste
reduction and recycling plan is proposed to be adopted, or a proposed
amendment of a waste reduction and recycling plan will substantially affect
the operation of the plan, the proposed plan or amendment must be made
available for public comment, including especially by households and
businesses, for at least 28 days.
(5) The local government must, in
finalising a plan or amendment for adoption, take into account any submissions
received about the plan or amendment.
