(2) To the extent the obligation was contravened before the
repeal, proceedings may be taken, or continue to be taken, against the person
who contravened the obligation, and the person may be punished, as if the
repeal had not happened.
(3) If—
(a) the acts or omissions constituting the
contravention continue after the repeal; and
(b) the continuing acts or
omissions contravene a duty imposed by a provision of this Act;
proceedings
may be taken against the person under the provision of this Act to the extent
of the continuation of the acts or omissions after the repeal.
