Costs if proceeding could have been brought in a lower court
318 Costs if proceeding could have been brought in a lower court
(1) If the
amount of damages a court awards could have been awarded in a lower court, the
court must order any costs in favour of the claimant under the scale of costs
applying in the lower court.
