(1) If the claimant is a
worker who does not have a terminal condition and the claimant’s notice of
assessment states that the claimant’s DPI is 20% or more, part 12 , division
1 applies in relation to costs in the claimant’s proceeding for damages.
(2) If the claimant is a worker who does not have a terminal condition and the
claimant’s notice of assessment states that the claimant’s DPI is less
than 20%, part 12 , division 2 applies in relation to costs in the
claimant’s proceeding for damages.
(3) If the claimant is a worker who has
a terminal condition, part 12 , division 1 applies in relation to costs in the
claimant’s proceeding for damages.
(4) If the claimant is a dependant, part
12 , division 1 applies in relation to costs in the claimant’s proceeding
for damages.
