Relevant company may request water entitlement
992O Relevant company may request water entitlement
(1) This section applies if the chief executive and a relevant company agree
to wholly or partly replace the company’s authority to take or interfere
with water under a special agreement Act with 1 or more water entitlements.
(2) The relevant company may request the chief executive to grant the company
1 or more water entitlements for the company’s take of, or interference
with, water.
(3) The relevant company may make more than 1 request under
subsection (2) if the company wishes to replace the company’s authority to
take or interfere with water under a special agreement Act in stages.
(4) The
request must include sufficient information to support the request.
(5) If
the relevant company makes a request under subsection (2) , the chief
executive must, within 30 business days after receiving the request, grant the
company a water entitlement or water entitlements in accordance with the
request.
(6) A water entitlement may be granted with or without conditions.
(7) Chapter 2 , part 3 , division 2 , subdivision 2 does not apply to the
grant of any water entitlement under this section.
