Limiting compensation for reduced value of entitlement to water
987 Limiting compensation for reduced value of entitlement to water
(1) Despite section 986, compensation is not payable if the change has the
same effect as another statutory instrument, in respect of which compensation
is not payable.
(2) Also, compensation is not payable—
(a) for a matter
under this part if compensation has already been paid for the matter to a
previous owner of the authority to take water; or
(b) for anything done in
contravention of this Act.
(3) If a matter for which compensation is payable
under this part is also a matter for which compensation is payable under
another Act, the claim for the compensation must be made under the other Act.
