Unauthorised taking, supplying or interfering with water
808 Unauthorised taking, supplying or interfering with water
(1) A person must not take or supply water to which this Act applies unless
authorised to take or supply the water—
(a) under this or another Act; or

(b) under a law of another
State or Territory if the authorisation is declared under a regulation to be
of a similar nature and to have a similar effect to a stated authorisation
under this Act.
Penalty—
Maximum penalty—1,665 penalty units.
Note—
If a corporation commits an offence against this provision, an
executive officer of the corporation may be taken, under section 828, to have
also committed the offence.
(2) A person must not interfere with water to
which this Act applies, other than overland flow water, unless authorised to
interfere with the water—
(a) under this or another Act; or

(b) under a law of another State or
Territory if the authorisation is declared under a regulation to be of a
similar nature and to have a similar effect to a stated authorisation under

(3) The holder of a metered entitlement must
not take water under the entitlement other than through works that have an
approved meter attached.
